Mana Market Terms of Service

Overview
Welcome to Mana Market. In these terms, "we", "us" and "our" mean UPROAR GAMES PTY LTD (ABN 64 600 384 629) trading as Mana Market. "You" means the person accessing our website or buying from us.
These Terms of Service, together with the policies referred to in them, set out the terms on which we supply products through our online store at https://manamarket.com.au (the "Services"). Our store is hosted on Shopify.
Please read these terms carefully. They include important information about your rights, our obligations, and the limits of our liability.
By browsing, using or purchasing through the Services, you agree to these Terms of Service. If you do not agree, please do not use the Services.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
1. Access and your account
You may browse our store without an account, but you will need to provide certain information to place an order, including your name, email address, delivery address and payment details.
You agree that the information you give us is accurate, current and complete, and that you will keep it up to date.
You are responsible for keeping your account credentials secure and for activity that occurs under your account. Please tell us straight away if you believe your account has been accessed without your permission. You may not sell, transfer or share your account with anyone else.
2. Customers under 18
Many of the products we sell are enjoyed by younger players and collectors, and we welcome them. However, if you are under 18 you may only place an order with the involvement and consent of a parent or guardian, and that parent or guardian accepts responsibility for the order and for these terms.
Where we reasonably believe an order has been placed by a person under 18 without parental consent, we may cancel the order and refund the amount paid.
3. Our products
3.1 Product images
Most of our single card listings use stock images. A stock image shows the card design, not the specific card you will receive. It is there to help you identify the card, and it does not represent the condition of the individual card we send you. The condition you receive is the condition stated in the listing, assessed against our Card Condition Guide.
Where a listing displays a photograph or scan of the actual card, usually on higher value singles and graded cards, that image shows the specific item you will receive and takes priority over the general condition description.
If you would like to see the actual card before you buy, contact us at singles@manamarket.com.au and we will send you images where we reasonably can.
Because trading cards are photographed under different lighting and viewed on different screens, colours, gloss, holographic patterning and texture may look different on your device to how the card looks in hand. Screen variation on its own is not a product fault.
Product descriptions, images and availability may change at any time without notice. We may discontinue a product or limit the quantity available to any person or region.
3.2 Single cards and condition
Single cards are pre-owned or removed from sealed products. We assess conditions against our Card Condition Guide (https://pages.ebay.com/cardconditions), which follows the eBay Card Condition Guidelines for raw cards. Those guidelines use four grades: Near Mint, Lightly Played, Moderately Played, Heavily Played and Damaged.
Two principles from that standard apply to everything we sell:

The most significant flaw sets the grade. A card that is otherwise Near Mint but has one moderate crease is graded on the crease.

These grades apply to raw cards only. They are not equivalent to, and should not be compared with, a numerical grade from PSA, CGC, BGS or any other professional grading company. A card we describe as Near Mint carries no expectation of any particular grade if you later submit it for grading.
Condition assessment involves human judgement and there is a reasonable degree of variation within each grade. Cards graded Near Mint may show minor manufacturing imperfections, including light print lines, centring variation, minor edge whitening and factory surface texture. These are inherent to how cards are produced and are not defects.
Unless a listing says otherwise, cards are sold ungraded and unauthenticated by a third party. Where a card is signed, stamped or inked, that is described separately in the listing and is not covered by the condition grade.
If you receive a card that does not match the condition it was sold in, see section 10 (Returns and your consumer rights).
3.3 Professionally graded cards
Cards graded by PSA, CGC, BGS or another third party grading company are sold in the holder assigned by that grader.
The grade is the opinion of the grading company, not ours. We do not warrant that a grade is accurate, that a card would receive the same grade on resubmission, or that a holder will be free from minor manufacturing marks, scuffs or bubbles introduced by the grader. We do warrant that the holder and label we send you are genuine and unaltered, and that the holder is intact when it leaves us.
If a graded card arrives with a cracked or damaged holder, contact us within the timeframe in section 10 and we will make it right.
3.4 Sealed product
Sealed product is sold as manufactured and sealed by the publisher. We do not open, weigh, search or alter sealed products.
We make no representation about what a sealed product contains beyond what the manufacturer states on the packaging. Pull rates, hit rates and card contents are determined by the manufacturer and are outside our control. A sealed product that does not contain a particular card is not faulty.
Sealed products may show shelf wear, minor crushing or dents to outer packaging from transit and handling. Where packaging condition matters to you, please check the listing or contact us before ordering.
Once a sealed product has been opened it can no longer be returned other than as required by the Australian Consumer Law.
4. Orders
When you place an order you are making an offer to buy. Our automated order confirmation email acknowledges that we have received your order. It does not mean we have accepted it.
Your order is accepted, and a contract is formed, when we dispatch the products to you or notify you that they are ready for collection. Where an order contains several items, we accept your order in respect of each item as it is dispatched.
We may decline or cancel an order before acceptance, including where:
-
the product is out of stock or has been mispriced;
-
we cannot verify your payment or delivery details;
-
we reasonably suspect fraudulent, automated or resale-driven ordering; or
-
the order breaches a purchase limit under section 5.
If we decline or cancel your order we will tell you using the contact details you gave us, and we will refund any amount you have paid for that order in full.
Please check your order carefully before submitting. We will do our best to accommodate changes or cancellations before dispatch, but we cannot guarantee it.
5. Purchase limits, allocation and releases
New releases and high demand products are often supplied to us in limited quantities. To keep access fair we may:

set a maximum quantity per customer, household, payment method or delivery address;
-
allocate stock across orders where demand exceeds supply and partially fulfil orders; and
-
cancel or refuse orders that we reasonably believe were placed using bots, scripts, automated checkout tools, or multiple accounts to circumvent a purchase limit.
Where we apply a purchase limit we will display it on the product page. Where we cancel an order under this section, we will refund you in full.
6. Preorders and presales
Preorder items are products that have not yet been released or that we have not yet received from our supplier.

Release dates are estimates. Publishers regularly change street dates, delay releases and adjust allocations. We will let you know as soon as we can if a date moves.

Payment. Unless the listing says otherwise, payment is taken at the time you place your preorder.

Cancellation by you. You may cancel a preorder at any time before it is dispatched for a full refund. Contact us at singles@manamarket.com.au

Cancellation by us. If our supplier reduces or cancels our allocation, or the product is not released, we may cancel your preorder in whole or in part and will refund you in full.

Price changes. The price you pay is the price at the time you placed the preorder. If the recommended retail price rises before release, we will honour your price. If our price falls before release, we will refund you the difference.

Mixed orders. If you order preorder and in stock items together, we will hold the whole order until the preorder item is available unless you ask us to split it. Additional postage may apply to split shipments.

Reasonable time. If we are unable to supply a preordered product within a reasonable time, you are entitled to cancel and receive a full refund. This right is in addition to your rights under the Australian Consumer Law.
7. Prices, GST and payment
All prices displayed on our store are in Australian dollars and include GST where applicable.
Delivery charges are shown separately at checkout before you complete your order. The total amount payable, including delivery, is displayed before you confirm.
Prices, discounts and promotions may change at any time. The price that applies to your order is the price displayed at the time you place it, as set out in your order confirmation.
Prices in our online store may differ from prices in our Southport store or on other platforms we sell through, including eBay.
Promotions may have their own terms. Where a promotion's terms conflict with these terms, the promotion terms apply to that promotion.
By providing payment details you confirm that you are authorised to use the payment method and that the details are accurate. If a payment is declined, reversed or charged back, we may suspend or cancel your order and recover any amounts owing.
Where we accept a card payment surcharge, it will not exceed our cost of accepting that payment method and will be disclosed at checkout.
8. How we price, and pricing errors
Prices for single cards are set automatically. We use third party pricing software that draws on trading card market data, most of which reflects United States market activity, and converts it into Australian dollars. Prices update frequently and without notice, and the price of a card may change between the time you view it and the time you place your order. The price that applies to your order is the price displayed at the time you place it.
Because pricing is automated and market data can be incomplete or incorrect, a product will occasionally appear at a price that is clearly wrong. Examples include a decimal point error, a price that is a small fraction of the card's obvious market value, or a data feed failure that returns a default value.
Where a product is listed at a price that is clearly wrong and you could reasonably have recognised it as an error, we may cancel the order before dispatch and refund you in full. We will not cancel an order under this section simply because a card's market value has risen since you bought it, or because our automated pricing has since moved.
We may correct errors, inaccuracies and omissions in product descriptions, pricing, promotions, delivery charges and availability at any time.
9. Delivery and collection
9.1 Delivery
We deliver within Australia only.
Delivery timeframes shown at checkout are estimates based on carrier information. They are not guaranteed and do not form part of our contract with you.
We are responsible for your order until it is delivered to the address you provide. If your order is lost, stolen or damaged in transit, contact us and we will replace it, resend it or refund you. This reflects your rights under the Australian Consumer Law and we do not attempt to shift transit risk to you.
Two exceptions apply. We are not responsible where:
-
you provide an incorrect or incomplete delivery address; or
-
you give an authority to leave, or the carrier's tracking shows delivery was completed to the address you provided, and the parcel is subsequently taken. We will still assist you to lodge a claim with the carrier.
Where we reasonably suspect fraud, we may require signature on delivery or additional verification before dispatching high value orders.
9.2 Click and collect
Orders placed for collection are available at our Southport store during trading hours. Please bring your order confirmation and photo identification.
Orders paid online. If your order is not collected within 90 days and we have been unable to contact you using the details you provided, we may deal with the goods in accordance with the Disposal of Uncollected Goods Act 1967 (Qld). We will contact you before doing so.
Orders reserved for payment on collection. Where you have placed an order to be paid for in store, we hold the items for you for 7 business days. When we notify you that your order is ready, that notification will state the date by which you need to collect and pay for it. If you have not done so by that date, the order is cancelled automatically and the items are returned to general stock. No payment is due from you and no fee applies.
We may set a shorter holding period on limited release or high demand products. Where we do, the period will be shown at the time you place your order.
If you need more time, contact us before the holding period ends and we will extend it where we reasonably can.
10. Returns and your consumer rights
10.1 Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in this section limits those rights.
10.2 Condition disputes on single cards
If you believe a single card you received does not match the condition it was sold in, contact us at singles@manamarket.com.au within 7 days of delivery with:
-
your order number;
-
clear photographs of the front and back of the card in good light; and
-
a short description of the issue.
We will review the card against our Card Condition Guide. If we agree it was misgraded, you may choose a full refund including return postage, a replacement if we have one, or a partial refund reflecting the actual condition. We will provide a prepaid return label where a return is required.
Cards must be returned in the same condition and packaging in which they were sent.
10.3 Damaged or incorrect items
If your order arrives damaged, or you receive the wrong item, contact us within 7 days of delivery with photographs of the item and packaging. We will arrange a replacement or refund and cover return postage.
10.4 Change of mind
We do not offer refunds or exchanges for change of mind on single cards, sealed products or graded cards. This does not affect your rights under section 10.1.
10.5 How refunds are paid
Refunds are made to the original payment method within 3 business days of us approving the refund.
11. Store credit
Where we issue store credit, it:
-
is valid for at least three years from the date of issue;
-
can be used on any product in our online store unless we say otherwise at the time of issue;
-
is not redeemable for cash and cannot be transferred or sold; and
-
is not reduced by any fee for holding or using it.
If store credit is issued as part of a refund under the Australian Consumer Law, you may choose a cash refund instead.
12. Our other services
We offer several services that are governed by their own terms:

Where you use one of those services, the terms for that service apply to it. These Terms of Service apply to your use of our website generally and to purchases from our online store.
13. Intellectual property
Our website, including its text, images, product photography, graphics, video, layout, design and the selection and arrangement of that material, is owned by us or our licensors and is protected under the Copyright Act 1968 (Cth) and other intellectual property laws.
You may use our website for your own personal, non-commercial purposes. You must not reproduce, distribute, modify, republish, scrape, store or transmit any material from our website without our written consent.
"Mana Market" and our logos are our trademarks. You must not use them without our written permission.
Pokémon, Magic: The Gathering, Yu-Gi-Oh! and all other game titles, card images, character names and logos are the property of their respective owners. We are not affiliated with, endorsed by or sponsored by those owners. We sell genuine products produced by them.
Shopify's name, logo and product names are trade marks of Shopify.
14. Reviews and feedback
If you submit a review, comment, idea, suggestion or other content to us, you grant us a worldwide, royalty free, sublicensable licence to use, reproduce, modify, publish and display it for any purpose connected with operating and promoting our business.
You confirm that the content is yours to give, that it is honest, and that you have disclosed any payment or incentive you received in connection with it.
We may remove content that is unlawful, misleading, abusive, defamatory, obscene, that infringes someone's rights, or that is not a genuine review. We do not remove or edit reviews simply because they are negative, and we do not publish reviews that we know to be fake.
We are not obliged to keep your submission confidential, to pay you for it, or to respond to it.
15. Third party tools and links
Our website may give you access to tools, apps and content provided by third parties, and may link to third party websites.
We do not control those tools or websites and we provide access to them without warranty or endorsement. If you use them, you do so at your own risk and subject to the third party's own terms. Please review those terms before you use the tool or make a purchase.
This section does not limit our responsibility for the products we sell you or for our own conduct.
16. Relationship with Shopify
Our store is powered by Shopify, which enables us to provide the Services to you. Any sale you make is directly with Mana Market. Shopify is not a party to that sale and is not responsible for any aspect of it, including any injury, damage or loss resulting from products you purchase from us. To the extent permitted by law, you release Shopify and its affiliates from claims arising from your transactions with us.
17. Privacy
We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
Because our store is hosted by Shopify, information you submit is transmitted to and processed by Shopify and its service providers, some of whom are located outside Australia.
18. Acceptable use
You may use our website for lawful purposes only. You must not:
-
use the website for any unlawful, fraudulent or malicious purpose;
-
infringe our intellectual property rights or those of anyone else;
-
harass, abuse, threaten, defame or intimidate our staff or other customers;
-
provide false or misleading information, or impersonate anyone;
-
upload viruses or malicious code;
-
scrape, crawl, spider or harvest data from the website, including pricing and inventory data, without our written consent;
-
use bots, scripts or automated tools to place orders or to gain an advantage on limited stock;
-
collect other people's personal information; or
-
interfere with or attempt to bypass the security of the website.
19. Suspension and termination
We may suspend or close your account, or refuse to supply you, where you have materially breached these terms, where we reasonably suspect fraudulent or automated ordering, or where continuing to supply you would expose us or our staff to abuse or legal risk.
Except where the breach is serious or we are legally prevented from doing so, we will give you notice and a reasonable opportunity to fix the problem first. We will refund you for any paid order we do not fulfil.
You may close your account at any time by contacting us.
Sections that by their nature should continue after termination will continue, including sections 13, 14, 20, 21, 22 and 25.
20. Our liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to:
-
replacing the goods or supplying equivalent goods;
-
repairing the goods;
-
paying the cost of replacing the goods or acquiring equivalent goods; or
-
paying the cost of having the goods repaired.
Subject to the above, and to the extent permitted by law:
-
we are not liable for indirect or consequential loss, loss of profits, loss of opportunity, loss of anticipated resale value, or loss of data arising from your use of our website or the products you buy from us; and
-
our total liability arising out of any order is limited to the amount you paid for that order.
We do not warrant that our website will be available uninterrupted, error free or secure, and we are not liable for loss arising from the unavailability of our website, except to the extent it prevents us from supplying products you have already paid for.
You acknowledge that trading card values fluctuate and that we make no representation about the current or future value, investment merit or resale price of any product.
21. Indemnity
You are responsible for loss, damage or cost we reasonably incur as a result of your breach of these terms, your unlawful conduct, or your infringement of a third party's rights.
This does not apply to the extent the loss was caused or contributed to by us, and it does not apply to a consumer to the extent that applying it would be unfair within the meaning of the Australian Consumer Law.
22. Complaints and disputes
If something has gone wrong, please contact us first at store@manamarket.com.au or (07) 5625 2777. We aim to acknowledge complaints within 2 business days and to resolve them within 10 business days.
If we cannot resolve your complaint, you may contact the Office of Fair Trading Queensland or the Australian Competition and Consumer Commission. Nothing in these terms prevents you from exercising any legal right.
23. Changes to these terms
We may update these terms from time to time. The current version is always available on this page and shows its effective date.
Where a change materially affects your rights, we will give you reasonable notice, for example by email or a prominent notice on our website, before it takes effect. If you do not accept a material change you may stop using the Services and close your account.
Changes do not apply retrospectively to orders already accepted. The terms that apply to your order are the terms in effect when you placed it.
24. General
Severability. If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply.
Waiver. If we do not enforce a right, that does not waive it.
Assignment. You may not transfer your rights or obligations under these terms without our consent, which we will not unreasonably withhold. We may transfer our rights and obligations to another entity, provided doing so does not reduce your rights, and we will tell you if we do.
Entire agreement. These terms, together with the policies they refer to, form the entire agreement between us in relation to your use of our online store.
Headings. Headings are for convenience only and do not affect interpretation.
25. Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them. This does not prevent you from bringing a claim in a tribunal or court in your own state or territory where the law entitles you to do so.
